investigating a shooting at an apartment complex. it happened just after 11 last night. police found a woman suffering from multiple gunshot wounds in a parking lot at the lord tennyson apartment complex. she was taken to a nearby hospital and remains in surgery. it is unclear if she will survive from her injuries. we have a crew on the way and will bring you a live report shortly. our top story this morning. bart trains have been running for a week and a

half, but the agreement that ended the strike is still not official. today barts union member will vote on the tentative deal. union members are considering a deal that would increase their salary by more than 15% over 4

years, but also require a bigger contribution to pensions and health beneifts. union leaders are recommending their members accept the deal. the bart board will vote on

the contract after it has been ratified by the two unions. the california public utilities commission has approved new safety regulations for rail workers that are believed to be the first of their kind in the

nation. the new rules include mandatory three-way radio workers, train operators and central command. train speed restrictions and warning flags will also be required in work areas. the cpuc unanimously passed the new rules less than two weeks after two bart workers were killed while working on tracks. today marks the official start to the winter spare the air season. that means burning wood or other solid fuels are illegal on certain days. because they could create health hazards. last season, air quality officials received more than two thousand complaints about wood smoke and issued 178 ticket violations. the four story barge floating in the san francisco harbor is no longer a mystery. kron-4's justine waldman has uncovered google's plan for the barge -- and it's final destination and purpose. in milpitas, a father faces

child endangerment charges after leaving his two young children alone in a vehicle for more than 14 hours. julio reyes was taken into custody wednesday night. more than 24 hours after leaving his children behind in an s-u-v on hillview drive. someone called 9-1-1 wednesday afternoon to report a suspicious vehicle. inside, police found a 10 year old girl and an 8 year old boy. tired, disheveled and hungry. the kids were left in the vehicle since tuesday night after their father says he went to go to a friend's home nearby. t want to be shown on camera, says his wife heard something

suspicious. the children are o-k and are now in protective custody. its not clear why reyes left his children in the vehicle for so long. he did call milpitas police to report his vehicle and children missing before his arrest. with the end of daylight savings time this weekend.the days will be getting shorter. and so will the hours for the bay bridge bike path. starting this friday.the path will have new "winter hours". it will be open from 7 a- m to 5:30 p -m. officials say if you're planning to walk the four miles across the bridge.you should head out before 4 p- m to have enough time. c -h -p monitors the path and will begin clearing the path around four in the afternoon. the "winter" hours will be

after seeing its healthcare.gov cover girl go from stock photo to laughingstock, the obama administration is considering using pictures of people who've successfully purchased insurance instead. the photo of a smiling young woman recently was removed from the problem- plagued website. but a new hampshire woman and a florida college student say the administration has sought their permission to use their photos instead. the department declined to comment specifically on whether their photos will be used on the insurance

joining us live now in hayward is mike pelton. >>: right now police have a mystery on their hands in terms of exactly what took place here. if you officers are still here investigating the accident the years with the scene looked like just a few hours ago as police received shots fired calls just after 11:00 last night here at the lower tenants' apartments. they found a woman in the parking lot suffering from multiple gunshot wounds. she was taken to hospital but police did not know if she lives here where the shooting took place or really what happened. >>: right now, there's not a lot of leads for us to go on. our inspectors are currently working avery and so they can and eventually we will be able to get something soft. it's unaware if she lives at a unit or if she happens to be visiting and the area. we don't know where she is. we have not

to turn our attention to the city alert. the fatal accidents we have been following. this is in the northbound direction at scott creek road. what happened is earlier this morning to contract workers were on the freeway doing some construction work when a car crashed into them for it and that actually did result in the fatality of one of the workers on the scene. chp emergency crews are on their way out there. looks like the no. 3 line is blocked off until further notice for it we have a live crew on scene right now so hopefully we will have a live shot and a couple of minutes. if you take north bound 680 you may encounter a minor attack on the bridge approaching the scene of the crash. if you do want a a alternate looks like 880 is moving well in both directions. centel bridge problems free. toll plaza looking go with it drive time of 12 to 13 minutes. southbound 101 the golden gate bridge we are seeing lots of space between cars.

the talks started several months ago. ft. mason is working with google's public policy and government affairs department on the project. but the deal still needs to be approved and details as to when the barge will be moved and how long it will be at ft. mason have not been disclosed. we've also learned the treasure island development authority made a lease agreement with "by and large l-l-c" out of delaware. and that the lease ends in august of next year. right now, rent at hangar three is 12-thousand dollars a month but in november, the price skyrockets to 79- thousand a month. concord police are investigating a theft at the construction site of a new building for a charity organization. around 18 - thousand dollars in copper wire and construction tools were stolen tuesday night for the monument crisis center's new building on market st. the monument crisis center serves thousands of local families each month. providing a food program and after-school tutoring. the project was to finish by the end of the year.but now the group says their goal is in jeopardy. police do not have any suspects at this time.
